These terms apply when you use the Tradexa website and service. Please read them. By using our website, enquiring, or using the app, you agree to them.
1. About these terms
These are the general terms for our website and service. When you sign up as a paying client, the specific commercial terms (what is included, the price, and the billing cycle) are set out in the quote or service agreement we give you. If anything in that agreement conflicts with these terms, the agreement wins for that client.
2. The website
Our website gives you information about Tradexa, a lost-revenue calculator, a demo, and a way to enquire. The calculator is an illustration only, based on the numbers you enter. It is not a promise of results or savings. The demo uses sample data, not real calls.
3. What Tradexa does
Tradexa helps trade businesses catch missed calls and follow up leads. Our core product is a web app that shows your incoming and missed calls, with urgent ones first. We can also set up related lead and booking systems for you. Exactly what you get depends on the plan you sign up for.
4. Who can use it
The service is for businesses, and you must be at least 18 and able to enter a contract. By using it you confirm you are using it for your business.
5. Your account
You are responsible for keeping your login secure and for what happens under your account. Tell us straight away if you think someone else has access.
6. Fees and payment
The fees, what they cover, and how often you are billed are set out in your quote or service agreement, not on this page. Unless we agree otherwise, fees are payable in advance and are in Australian dollars. We will give you reasonable notice before changing your ongoing fees.
7. Your responsibilities
- Give us accurate information when you sign up and keep it up to date.
- Comply with the laws that apply to your business, including how you contact and record your own customers. Call recording laws differ between states. Where calls are recorded, you are responsible for telling your customers and getting any consent the law requires.
- Have your own privacy practices for your customers' information, since that information is yours, not ours.
- Not use the service for anything unlawful, misleading, or harmful.
8. Third-party services
Tradexa runs on top of other providers, including our AI phone assistant, the telephone network behind it, the tools that route your leads, and our hosting and email providers. We are not responsible for outages, changes, or issues caused by those third parties, though we will do what we reasonably can to keep your service running.
9. Availability and results
We work hard to keep the service running, but we cannot promise it will always be available or error-free, or that every call will be captured. Things like phone network issues, third-party outages, or incorrect setup on the phone system can affect it. We do not guarantee any particular number of leads, jobs, or revenue.
10. Intellectual property
We own the Tradexa name, website, app, and materials. You may use them only as part of using the service. Your business data and your customers' data remain yours.
11. Your rights under Australian Consumer Law
Nothing in these terms excludes, restricts, or changes any right or guarantee you have under the Australian Consumer Law that cannot legally be excluded. Where we are allowed to limit our liability, we limit it to re-supplying the service or paying the cost of having it re-supplied.
12. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential loss, including lost profits, lost business, or lost data, arising from your use of the service. Our total liability to you for any claim is limited to the fees you paid us in the three months before the claim.
13. Ending the service
You can stop using the service in line with your service agreement. We may suspend or end access if you breach these terms or do not pay, and we will give you reasonable notice where we can. When the service ends, we handle your data as described in our Privacy Policy.
14. Changes to these terms
We may update these terms from time to time. The current version is always on this page, with the "last updated" date at the top. If a change materially affects clients, we will take reasonable steps to let them know.
15. Governing law
These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have jurisdiction.
